Use of services

Acceptable use

Messaging compliance
If you use features that send email or SMS messages, you are responsible for obtaining and documenting prior express consent from each recipient and for honoring opt-out requests promptly. You agree to comply with all applicable messaging regulations, including the TCPA, CAN-SPAM, and carrier requirements. We may suspend messaging features for accounts that generate excessive complaints or appear to violate these requirements.
Fees
Paid services are billed on the schedule disclosed at the time of purchase. Fees are non-refundable except where required by law. We will provide notice before any change to recurring pricing.
Intellectual property
All software, content, and branding provided by 95&Change remain our property. You retain ownership of the data you submit to the services.
Disclaimer and limitation of liability
Our services are provided "as is" without warranties of any kind, express or implied. To the maximum extent permitted by law, 95&Change LLC is not liable for indirect, incidental, or consequential damages arising from the use of our services.
Termination
You may stop using the services at any time. We may suspend or terminate access for violation of these Terms or for nonpayment.
Governing law
These Terms are governed by the laws of the State of Maryland, United States, without regard to conflict of law principles.
